Venue & Jurisdiction (Private Domain Governance)

As Anointed Motherhood Ministries operates as a Private Health Ministerial Association (“Association”), all interactions, exchanges, services, communications, and agreements between the Association and its members occur exclusively within the private domain and under the protections of the Universal Declaration of Human Rights (UDHR), the U.S. Constitution, relevant State Constitutions, and all applicable principles supporting freedom of association, private contract, and religious exercise.

By joining the Association and continuing to use this website, you agree that:

  1. Private Law Governs This Agreement
These Terms and Conditions, along with the Association’s Privacy Policy and Membership Agreement, are governed by private contract law as formed between members of a private Association.
They are not governed by public statutes, agency rules, or state/federal regulatory frameworks that apply to public commerce or public persons.

  2. Venue Is the Private Domain of the Association
All matters relating to construction, validity, performance, enforcement, or interpretation of this Agreement shall take place within the private jurisdiction of the Association, not within the public courts or agencies of the State of California or any other state.

  3. Jurisdiction Is Exclusive to the Association
Any dispute, claim, or controversy arising from or relating to your membership, use of this website, or any Association offering must be handled solely through the Association’s private dispute-resolution process, which includes:

    • private mediation, and

    • private binding arbitration or tribunal,
as described in the preceding section.

  4. Waiver of Public Court Jurisdiction
    Members expressly and voluntarily agree:

    • not to seek remedy, resolution, or legal action in any state or federal court, and

    • not to involve public agencies, boards, or regulatory entities,
except where law requires intervention in cases of clear and present danger—and only with Association approval.

  5. Location for Private Proceedings
Should private mediation or arbitration require an in-person component, the location shall be Riverside County, California, or another mutually agreed-upon location within the private domain of the Association. Virtual participation may be used when appropriate.

  6. Costs and Fees
    Each member agrees to:

    • take responsibility for their own legal, advisory, or representation expenses, and

    • share equally in any administrative or procedural costs required for private dispute resolution,
unless otherwise determined by the Association’s arbitrator, tribunal, or designee.

By continuing as a member and using this website, you affirm and consent to the Association’s exclusive private venue, private jurisdiction, and private governing law, and you acknowledge that all matters are conducted outside the public domain.

Private Mediation & Arbitration (Dispute Resolution Within the Association)

As a condition of membership in Anointed Motherhood Ministries, a Private Health Ministerial Association (“Association”), all members agree that any and all disputes, claims, concerns, or controversies arising out of or relating to these Terms and Conditions, the use of this website, participation in any Association offerings, or interactions between members shall be resolved exclusively within the private domain of the Association.

Because Anointed Motherhood Ministries operates as a Private Membership Association under the protections of the Universal Declaration of Human Rights (UDHR), the U.S. Constitution, relevant State Constitutions, and all applicable provisions supporting freedom of association, all disputes must remain outside the jurisdiction of public courts, agencies, officers, or government representatives unless otherwise required by law and approved by the Association.

1. Private Mediation (Required First Step)

Before any arbitration or tribunal process may be initiated, the parties agree to engage in good-faith private mediation.

  • Mediation will be conducted privately between members within the Association’s private domain.

  • Mediation shall take place either virtually or in person in Riverside County, California, unless otherwise mutually agreed upon.

  • A mediator will be chosen from within the Association or from a mutually agreed-upon private mediator who is aligned with PMA principles.

  • Both parties agree to fully participate and attempt resolution in good faith.

If the matter is not resolved within thirty (30) days of the written request for mediation (or longer if agreed upon), the matter shall proceed to private arbitration.

2. Private Arbitration / Internal Tribunal

If mediation does not resolve the dispute, the matter shall be submitted to binding private arbitration, conducted exclusively within the Association.

  • Arbitration shall be overseen by an Association-appointed arbitrator, designee, committee, or tribunal.

  • Proceedings will take place in Riverside County, California, or virtually at the discretion of the Association.

  • Arbitration will be governed by the internal procedural rules of the Association, not by the American Arbitration Association or any public arbitration body.

  • The decision of the arbitrator or tribunal is final, binding, and enforceable within the private domain of the Association.

3. Costs

  • The administrative costs of arbitration shall be shared equally between the parties unless otherwise determined by the arbitrator or tribunal.

  • Each party is responsible for its own expenses, counsel, and materials.

4. Waiver of Public Remedies

By entering into membership and continuing to use this website, you acknowledge and agree that:

  • You voluntarily waive the right to pursue legal or administrative action in any public court, agency, or regulatory body against the Association or its members, except in cases of clear and present danger of substantive evil and only with Association approval.

  • All grievances, complaints, or disputes must be handled privately, in accordance with the Association's governing principles and dispute-resolution procedures.

This is consistent with the Association's protected rights under freedom of association, religious exercise, and private contract.

5. Agreement to PMA Jurisdiction

By continuing to use this website, receiving services, accessing offerings, or participating in any capacity, you affirm that:

  • You are acting in the private capacity of a member of Anointed Motherhood Ministries.

  • You agree that all disputes remain within the exclusive private jurisdiction of the Association.

  • You agree to abide by and participate in the Association’s mediation and arbitration processes as the sole remedy for any dispute.
